Registering your Indian marriage in Germany

Already married in India? Here's how to get your marriage officially recognised in Germany.

Germany does not automatically recognise foreign marriages. You must register your Indian marriage with the local Standesamt (civil registry office), which will then issue a German Heiratsurkunde.

Documents required

All Indian documents need an Apostille stamp (from India's MEA) and a certified German translation.

  • Indian marriage certificate — registered with the Indian Registrar's Office (Hindu Marriage Act, Christian Marriage Act, or Special Marriage Act)
  • Apostille stamp from India's Ministry of External Affairs (MEA) on the marriage certificate
  • Certified German translation of the marriage certificate by a vereidigter Übersetzer
  • Valid passports of both spouses
  • Birth certificates of both spouses (apostilled + translated)
  • Proof of current address in Germany (Meldebescheinigung)
  • Residence permits (Aufenthaltstitel) if applicable

Step-by-step process

Ensure your Indian marriage is formally registered

Your marriage must be registered with an Indian Registrar's Office, not just a religious ceremony. If only a religious ceremony was held, register under the Hindu Marriage Act (or applicable act) in India first.

Obtain the Apostille from India's MEA

Apply for an Apostille via MEA's eApostille portal (~3–4 working days) or through an authorised agent (₹2,000–₹7,000). Since both India and Germany are Hague Convention signatories, an Apostille is all you need — no further consular legalisation required.

Get a certified German translation

A vereidigter Übersetzer (sworn translator) in Germany must translate all documents. Cost: €100–€300. Translation agencies in all major German cities offer this; some work by post.

Book an appointment at the Standesamt

Contact the Standesamt in your registered municipality. Ask for an appointment to register a foreign marriage. Wait times are typically 4–8 weeks, book early.

Submit documents and receive your German certificate

Bring originals and copies. The registrar verifies validity under Indian law and issues a German Heiratsurkunde. Cost: €10–€70 for certified copies. If the registrar is unsure, they may refer to the German Foreign Office — add 2–8 weeks and ~€500–€600 for that.

Common pitfall: A religious ceremony certificate alone is never accepted. If your Indian marriage was registered late (more than a year after the wedding) or is a court order, the Standesamt may ask for additional documentation.

Getting married in Germany

Germany only recognises civil marriages at a Standesamt, religious ceremonies (Hindu, church, mosque) have no independent legal standing. Many couples do a civil ceremony first, then celebrate religiously.

All Indian documents must carry an Apostille from India's MEA and a certified German translation.

  • Valid passport (both partners)
  • Birth certificate with Apostille + certified German translation
  • Meldebescheinigung (proof of registered address in Germany)
  • Residence permit (Aufenthaltserlaubnis / Niederlassungserlaubnis) if applicable
  • Proof of single status — see the Oberlandesgericht process below
  • Divorce decree or death certificate if previously married (apostilled + translated)

The hardest part: Proof of single status (Ehefähigkeitszeugnis)

India does not issue an Ehefähigkeitszeugnis (certificate of no impediment to marry). German law requires it for foreign nationals. Since India can't provide one, you must apply to the Oberlandesgericht (Higher Regional Court) for an exemption, the Standesamt initiates this on your behalf.

The court reviews whether any impediment exists under Indian law and — if satisfied, grants a Befreiung (exemption). This takes 4–10 weeks and costs €100–€500 depending on complexity. A lawyer may be needed for complex cases.

Some Standesämter accept a sworn affidavit of single status from the Indian Embassy or Consulate in Germany as an alternative. Confirm with your specific Standesamt before relying on this.

Step-by-step process

Gather and apostille all documents from India

Start early — birth certificates and any prior divorce decrees all need MEA Apostilles and German translations. Allow 4–6 weeks for this from Germany (posting back and forth).

Book an Anmeldung zur Eheschließung appointment

This is your formal registration for marriage at the Standesamt. You can book up to 6 months ahead. The registrar reviews your documents and initiates the Oberlandesgericht exemption if needed.

Oberlandesgericht exemption

The Standesamt submits the application to the regional Higher Regional Court. Supply any additional documents or sworn declarations required. Expect 4–10 weeks for approval.

Attend the civil ceremony at the Standesamt

The ceremony takes ~30 minutes. Two witnesses required (anyone can serve). The registrar conducts in German, hire an interpreter (~€50–€100) if needed. You receive your Heiratsurkunde on the day.

Getting married in Denmark

The fast-track for Indians in Germany — no apostille upfront, no Ehefähigkeitszeugnis, done in 1–3 weeks.

A marriage in Denmark is automatically recognised in Germany, no re-registration needed. A bilateral agreement between Denmark and Germany (1936) covers this. You walk out of the ceremony with a marriage certificate valid in Germany, all EU states, and (with apostille) India.

You must be physically present. Tønder is ~2–3 hours from Hamburg by car. The ceremony takes 15–30 minutes. Two witnesses may be required — some municipalities help arrange witnesses locally.

Receive your multilingual marriage certificate

Tønder issues the certificate in 5 languages immediately after. Get several certified copies, needed for name changes, Steuerklasse, visa applications, bank accounts, and more.

Apostille the Danish certificate for India (if needed)
